Article 1. Definitions
The following definitions apply in these terms and conditions:

Article 3. Applicability
These general terms and conditions apply to every offer from Bavaria Bierkoerier and to every distance agreement concluded between Bavaria Bierkoerier and the customer via the Bavaria Bierkoerier webshop. Before the distance agreement is concluded, the text of these general terms and conditions is made available to the customer. If the customer cannot agree with the general terms and conditions, no agreement can be made between the customer and Bavaria Bierkoerier via the webshop. Given the nature of the products to be delivered, delivery must take place within the Netherlands.
Article 4. Age limit
Bavaria Bierkoerier does not provide alcoholic products to persons under 18 years of age. Before you can visit the website, an age verification will take place. If you want to place an order, you are required to enter your date of birth. Upon delivery of the order, the delivery person will ask for proof of identity. A valid proof of identity means a European identity card or a national passport.
Article 5. The agreement
The agreement is concluded at the moment the customer accepts the offer and meets the corresponding conditions. If the customer has accepted the offer electronically, Bavaria Bierkoerier will immediately confirm receipt of the acceptance of the offer electronically. Bavaria Bierkoerier excludes liability for any form of direct or indirect damage resulting from the purchase of Bavaria Bierkoerier in violation of existing contractual obligations.
Article 6. Right of withdrawal for consumers
When purchasing products, if the customer acts as a consumer within the meaning of Article 6: 230g of the Dutch Civil Code, the customer has the option of dissolving the contract within 14 days without giving any reason. This cooling-off period starts on the day following receipt of the product by the customer. During the cooling-off period, the customer will handle the product and packaging with care. If the customer exercises this right of withdrawal, the product will be returned to Bavaria Bierkoerier in its original packaging and without damage with all accessories supplied.
To exercise the right of withdrawal, Bavaria Bierkoerier must be informed of the decision to withdraw from the contract via an unambiguous statement. The customer can use the model withdrawal form as included in this condition for this, but is not obliged to do so.
If the customer exercises his right of withdrawal and has met all the conditions, Bavaria Bierkoerier will refund the amount paid including delivery costs as soon as possible, but no later than within 14 days after the return shipment. The costs for returning are for the account of the customer.
Article 7. Complaint handling
The order received must be checked immediately for visible or invisible damage. If there is visible or invisible damage to your order received, or you have a question or complaint, you can go to groningen.bavariabierkoerier.nl/service and then complete the contact form. You will then be contacted as soon as possible about the next steps.
Article 8. The price
During the validity period stated in the offer, the prices of the products offered are not increased. All prices are in euros and are clearly indicated on the website. Bavaria Bierkoerier cannot be held liable for deviations in prices, images and texts of the products as shown and stated on the website.
The prices on the website include excise duty, but excluding VAT, excluding delivery costs and excluding deposit unless otherwise stated. The delivery costs are clearly included in the total price to be paid before completing an order. The delivery costs per order depend on the order size and are specified on the site.
The Bavaria Bierkoerier crates are charged with a deposit. The amount of this packaging is stated on the site.
Article 9. Conformity and Warranty
Bavaria Bierkoerier guarantees that the products meet the agreement, the specifications stated in the offer, the reasonable requirements of reliability and / or usability and the legal provisions and / or government regulations existing on the date of the conclusion of the agreement.
Article 10. Delivery and implementation
The delivery service engaged by Bavaria Bierkoerier will take the greatest possible care when receiving and when executing orders.
If the customer is placed and paid before 9 p.m. on Monday to Sunday, the order in question will be delivered the next working day after receipt of payment. If the order is ordered and paid after 9 p.m., the order will be sent on the second working day. Orders ordered and paid before 8 p.m. on Saturday or Sunday will be delivered on Tuesday. The delivery times are on workdays from 11 a.m. to 5 p.m. On the Wadden Islands, we do not deliver on the next working day, but one day later, on the second working day. A different delivery rate also applies for this. The rates are stated on the site.
If the customer places an order on Friday and pays, the order will be sent the following Monday.
We strive to meet these delivery times and times, but unfortunately we cannot guarantee the delivery times. If the delivery is delayed, or if an order cannot or only partially be executed, the customer will be notified as soon as possible. In that case the customer has the right to terminate the agreement without costs. The delivery is carried out by an external party. Orders will only be delivered to the customer if they, or someone who accepts the order on behalf of the customer, can prove to be older than 18 by valid identification.
If no one is present at the agreed delivery address to whom delivery can or may be made, then in the case of a customer who is a consumer, the deliverers will attempt to deliver the order to the neighbors. The order will only be delivered to the neighbors if the receiving person is 18 years or older and can prove this on the basis of a valid proof of identity.
If delivery (at neighbors) is not possible, the products will be taken back and contact will be made to schedule a new appointment. Delivery costs will then be charged again.
All goods to be delivered are delivered on the ground floor and collected there again. The loading / unloading area must be easily accessible for our cars or those of our carriers.
Bavaria Bierkoerier reserves the right to change the delivery of the goods or not to deliver at all if the delivery location appears to be unsafe or risky with regard to any damage that may occur.
Article 11 Complaints, warranty, returns and force majeure
The customer must check the delivered goods on the date of delivery. Under penalty of cancellation of the right to complain, Bavaria Bierkoerier must be notified within 24 hours. From the moment of use, the customer loses the right to complain, unless it concerns a defect that only emerged during use. The foregoing does not affect the right of withdrawal of Article 6.
Any defects or incorrectly delivered goods are exchanged or returned free of charge within 3 working days.
Empty counted barrels are, after counting and checking in the warehouses of the Bavaria Bierkoerier forwarder, refunded within two working days after receipt of these goods, after deduction of any additional costs.
Bavaria Bierkoerier only returns barrels that are the property of Bavaria Bierkoerier.
When collecting empty barrels by appointment, they must be ready for dispatch on the agreed return date, starting at 8 a.m. in the same way in which they were delivered.
All containers supplied and packaged by Bavaria Bierkoerier remain the full property of Bavaria Bierkoerier and may never be resold and / or exchanged.
The customer indemnifies Bavaria Bierkoerier against possible claims from third parties. Bavaria Bierkoerier can also not be held liable for damage caused by the external carriers engaged by Bavaria Bierkoerier, unless this damage can be attributed to intent or gross negligence on the part of the external carrier.
The customer is fully responsible for the proper use of the product, including storage, and the connection to tapping installations and / or other installations. The customer is aware that carbon dioxide is required when tapping and that this entails safety risks in the event of improper use. Article 11. Data and privacy
When placing an order, the customer can disable (opt-out) the "check mark" that is allowed to send commercial e-mails for similar products from Bavaria Bierkoerier. If that does not happen, the permission granted thereby can be withdrawn at any time.
To process the order, the (personal) data of the customer and the e-mail address will be stored in an electronic file. This file will not be sold or provided to third parties, unless this is necessary for processing the order (for example in connection with delivery). Bavaria Bierkoerier ensures that the storage and processing of such data is in line with applicable laws and regulations.

Agreements between Bavaria Bierkoerier and the customer to which these general terms and conditions apply are exclusively governed by Dutch law. Any disputes that are directly or indirectly related to the webshop will be settled exclusively by the competent court in ‘s-Hertogenbosch.
Consumer withdrawal form
By law you have a right of withdrawal: within the trial period of 14 days you may return ordered items. This period starts when all items from the order have been delivered.
